Terms of Service

MobiTaste is a software-as-a-service product that lets restaurants accept orders through QR codes printed on their tables. It runs at mobitaste.com (marketing), app.mobitaste.com (your dashboard), and individual menu URLs we serve on your behalf.

We may update the service, add features, deprecate features, and tune defaults. If a change materially reduces functionality you depend on, we will email you at least 30 days before it takes effect.

You must be at least 18 years old to create an account. You are responsible for all activity that happens under your account, including any staff member you invite. Keep your password and any API tokens secret.

When you sign up on behalf of a restaurant or company, you confirm that you have authority to bind that organization to these terms.

Every paid plan starts with a 14-day free trial. No card is required to start the trial. At the end of the trial, you will be asked to choose a plan and provide a payment method through our billing partner (Paddle), who is our merchant of record.

Subscriptions auto-renew monthly. You can cancel at any time from the billing page in your dashboard; cancellation takes effect at the end of the current billing period and we do not pro-rate refunds.

Prices are listed on the pricing page and may change. We will give existing customers at least 30 days notice before any price increase, and you may cancel before it takes effect.

Refund policy: we will refund the most recent monthly payment within 14 days of the charge if you can show that the service failed to meet what we advertised. Outside of that window, all sales are final.

You may not use MobiTaste to sell anything that is illegal in your jurisdiction, to defraud anyone, to host content that incites violence or hatred, or to violate anyone's intellectual property or privacy rights.

You may not reverse-engineer, decompile, or attempt to extract the source code of our service. You may not scrape, mass-download, or otherwise abuse our APIs beyond the limits set out in your plan.

You may not resell access to MobiTaste under your own brand unless you are on a tier that explicitly includes white-label rights.

You retain full ownership of everything you put into MobiTaste: your menu, your restaurant name and branding, your customer orders, and any data your guests submit through your menu pages.

You grant us a limited, non-exclusive license to host, process, and display that content solely to deliver the service to you. We do not use your content for any other purpose.

You are the data controller for your guests' personal data (if any is collected). We are a data processor on your behalf. We will assist with subject-access requests and other GDPR/KVKK obligations on reasonable request.

MobiTaste — including our source code, design, the name, the logos, and the marketing site copy — belongs to us. We grant you a non-transferable, non-exclusive license to use the service under these terms. No other rights are granted.

You can terminate by deleting your account from the dashboard at any time. We retain a 90-day soft-delete window in case of accidents, then we hard-delete in line with the privacy policy.

We can suspend or terminate your account if you materially breach these terms (for example: non-payment, abusive content, fraud, security violations). We will give you written notice and a chance to fix the issue where reasonable.

The service is provided "as is". We do not warrant that it will be uninterrupted, error-free, or fit for any specific business goal beyond what is explicitly stated on the marketing site. We do not warrant any particular conversion rate, order volume, or financial outcome.

To the maximum extent permitted by law, our total liability to you for any claim arising from or relating to the service is limited to the amount you paid us in the 12 months before the claim arose.

We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or lost goodwill — even if we were advised of the possibility.

These terms are governed by the laws of the Republic of Turkey. Any dispute that cannot be resolved by good-faith negotiation will be decided by the courts of Istanbul (Çağlayan), Turkey.

We may update these terms. If we make a material change (anything that meaningfully expands your obligations or restricts your rights), we will email all account holders at least 30 days before it takes effect. Continued use after the change date is acceptance of the new terms.
